What types of trademarks can be registered in Ukraine?

In Ukraine, the following types of signs may be registered as trademarks: word (verbal) marks, figurative marks, 3D (three-dimensional) marks, combined marks, sound marks, position marks, pattern marks, motion marks, holograms, multimedia signs, color marks, provided they are capable of distinguishing goods or services of one party from those of others.

How long does it take to register a trademark in Ukraine?

Approximately 18-20 months under the standard procedure.

What is the difference between an invention and a utility model in Ukraine?

In Ukraine, both inventions and utility models are granted patent protection, but the legal requirements and scope of protection differ:

  • An invention may relate to a product (such as a device, substance, microorganism strain, plant or animal cell culture) or a process (method). It must be new, involve an inventive step, and be industrially applicable. Inventions undergo substantive examination, and protection is granted for 20 years from the filing date.

  • A utility model may relate only to a device or process (method). It must be new and industrially applicable, but no inventive step is required. Utility models are registered without substantive examination, making the process faster and more cost-effective. The term of protection is 10 years.

Utility models are suitable for simpler technical solutions or where speed to protection is critical, while inventions offer stronger, more robust protection for innovative technologies.

Is Ukraine a member of the Patent Cooperation Treaty (PCT)? Can national phase entry be made?

Yes, national phase entry is available within 31 months from the priority date.

What qualifies for design protection in Ukraine?

Design protection in Ukraine applies to the visual appearance of a product or its part, which may be defined by elements such as shape, lines, contours, colors, texture, materials, or decorative features.

A design can be protected if it is new and has an individual character.

What are the main enforcement options available in Ukraine?

In Ukraine, intellectual property rights can be enforced through civil, administrative, and criminal legal mechanisms, depending on the nature and severity of the infringement.

Additionally, rights holders may rely on customs enforcement by recording their IP rights in the Customs Register of IP Objects, allowing customs officials to detect and block counterfeit goods at the border.

Apart from formal legal proceedings, alternative dispute resolution (ADR) methods are also commonly used. These include negotiations, cease-and-desist letters, warning notices, and other pre-trial measures aimed at resolving disputes efficiently and avoiding litigation.

Each enforcement route offers different remedies such as injunctions, damages, seizure or destruction of infringing goods, and fines.

What is the role of the customs register of IP objects?

The Customs Register of IP Objects in Ukraine enables rights holders to record their intellectual property for customs monitoring. Once recorded, customs authorities are empowered to detect and detain counterfeit or infringing goods at the border during import or export operations.

This is an effective preventive tool to block the circulation of infringing goods before they reach the market.

Is post-grant invalidation of IP rights possible in Ukraine?

Yes. It is possible to file petitions to the Appeals Chamber of the Ukrainian IP Office for the total or partial invalidation of IP rights (“post-grant oppositions”) with respect to inventions, utility models, or designs held by third parties.

Trademark rights, however, can only be challenged through judicial proceedings. No administrative procedure for post-grant trademark invalidation is currently available in Ukraine.
