The largest branch competition among students «Moot Court Competition on Intellectual Property 2017» confirmed its status – the participating students demonstrated such level of knowledge that the top three winners were divided by the tenth of point and the winner of the Final Round was determined only after the tie-break.
On April 23, the World’s Day of Books and Copyright took place the Final Round of the Moot Court Competition on Intellectual Property organized by the UBA Students’ League and the IPStyle Patent Law Company. The day before was held the first Oral Round of the Competition in Kyiv at the Institute of Intellectual Property of the National University “Odessa Law Academy” where met the top ten teams, according to the results of evaluation of the submitted memorandums.
Twenty students were given an opportunity to demonstrate all of their knowledge, intelligence and the speed of reaction to the attacks of the opponent’s team in conditions as close as possible to the real trial.
In each round, the roles of the Claimant or of the Defendant for teams were determined by the drawing of lots. The teams represented their positions before the Board of Judges according to the received plot and tried to level the arguments of the opposite party.

Viktoriia Andreitseva, lawyer of ZEO Alliance, Oksana Blazhivska, Associate Professor of the Department of Intellectual Property of Taras Shevchenko National University of Kyiv, Judge of the Economic Court of Kyiv, Doctor of Law, Oleksandr Vozniuk, Head of JSC “Right and Law”, a member of the Council of Advocates of the city of Kyiv, attorney at law, Head of the All-Ukrainian NGO “Human Rights Union of the Disabled”, Kostiantyn Zerov, Assistant Professor of the Department of Intellectual Property of the Faculty of Law of Taras Shevchenko National University of Kyiv, Consultant of the Director of the Scientific and Research Institute of Intellectual Property of the NALS of Ukraine in the field of information technologies, co-founder of the NGO “Club of Intellectual Property”, Nataliia Kisil, Head of the Department of Research of Intellectual Property Objects in the State Enterprise “Information Court Systems” of the State Judicial Administration of Ukraine, Maryna Kornienko, Director of the legal department of the STB TV channel, Oksana Marchenko, judge of the Kyiv Economic Court, Mariya Ortynska, director of the IPStyle Patent Law Compant, attorney at law, patent attorney, Head of the AAU Intellectual Property Committee, member of the International Association of Trademarks (INTA) Anti-Counterfeiting Committee, member of the American Intellectual Property Association (AIPLA), member of the International Association for the Protection of Intellectual Property (AIPPI), Mykola Pototskyi, Head of the Department for the protection of rights and consideration of appeals of the State Enterprise “Ukrainian Institute of Intellectual Property” (Ukrpatent), Doctor of Law, Vladyslav Fedorenko, Director of the Research Center for Forensic Examination on Intellectual Property of the Ministry of Justice of Ukraine, Doctor of Law, Professor, Honored Lawyer of Ukraine, Tetiana Chabanets, Judicial Expert at the Research Center for Forensic Examination on Intellectual Property of the Ministry of Justice of Ukraine, Inna Shatova, Head of the Department of Legal Enforcement of Industrial Property of the State Service of Intellectual Property of Ukraine.
The right to participate in Oral Rounds have gained the students from five higher educational institutions from Kyiv, Ivano-Frankivsk, Chernivtsi and Kharkiv.
In total in the Competition participated 44 teams, which represented the universities from eight Ukrainian cities.
To the Final Round two teams from the same university (KNU them. T. Shevchenko) came out with the same result, got ahead of the third place only by 0.75 points under the 100-point system.
As a result in the Final Round, the teams again turned out to be equally strong and the Board of Judges consisting of Mariya Ortynska, Mykola Pototsky and Inna Shatova had to appoint an additional round.
And only after more than two hours of debate, winners were identified – Nataliia Badiora and Yelyzaveta Palyvoda from the Mens Legis team. Their official coach was Illarion Tomarov.
The second place was given to Anastasiia Homeniuk and Yana Rohoza from the Cleverin team. At the same time Yana Rohoza was awarded the “Best Oralist” Award.
The third place and the award for the best written memorandum was received by Ipso Facto team of students of the Institute of International Relations of the Kyiv National University. T. Shevchenko Vladislav Hlavatskyi and Kateryna Militsyna.
“It was really difficult for us to determine the winning teams after each round. The members of the Board of Judges, composed of professional judges, practicing lawyers, many of whom have a teaching experience, were really impressed by the level of preparation of the participants. Especially considering that the winners are only the third year students. It can not but inspire us that the market of intellectual property protection in Ukraine has a wonderful future”, – Mariya Ortynska shared her impressions.
