Why trademarks are valuable for business

To register a trademark or not? In fact, this should not be a question for those who want to develop their business and protect it. We explain why a trademark is an important step in entrepreneurship and what are the benefits of having a registered trademark for business...

Brand recognition. A registered TM is what distinguishes you from others in the market and allows you to identify your goods and services. It is also a goodwill and measure of the quality of the products or services that a company offers, a trust of consumers and clients.

Legal protection. A trademark helps protect your brand from being copied by others who use similar goods or services. So you have every chance to protect your business against fraud. Any use of TM without the owner's permission is illegal and entails liability. No one except the owner can operate the same business under such or a similar mark.

Contracts. It is safer and sometimes easier to conclude a contract or agreement when you have protected intellectual property, particularly a trademark. Potential partners and investors pay attention to this. It is also necessary for foreign market entry.

Marketplaces. Having a registered trademark, you can display and sell your goods on e-commerce sites and not be afraid of competitors. For example, to enroll a brand on Amazon and use advantages, your brand must have an active registered trademark or a pending trademark registration.

Franchise. A trademark is a key object transferred by a franchise agreement. In essence, one entity transfers to another the right to operate using its trademark. But there is nothing to transfer and monetize if the mark is not registered.

UA domain. In Ukraine, the .ua domain may be registered only on the basis of a trademark registration. There is no other way to register a domain-corresponding trademark. At the same time, having a domain and official document that confirms your exclusive right to use the mark gives you more clout than just using a generic term.

Valuable asset. A registered trademark is a non-monetary asset resource with a financial value for your business. You can transfer the right to use it to another entity, providing an additional source of income. You can put it on the balance sheet to add a capitalization source or you can sell it. This is an asset that has value.

Registered trademark helps you protect your brand identity, get legal protection in the competitive environment and valuable business assets. If you intend to start or expand your business internationally, you should register a trademark. This is one of the key drivers of business growth and long-term success.
