The IPSTYLE team has successfully assisted THE / DVIZH in overcoming trademark application refusal and registering in Ukraine.
THE / DVIZH is a community of the digital industry and specialists from digital agencies, owners of Instashops and e-commerce projects, targeting experts, media, and more. Its mission is to promote and develop digital entrepreneurship for Ukrainians both in Ukraine and abroad through educational products, online and offline communities, and broader economic impact.
During the trademark registration process, the THE / DVIZH owner received a provisional refusal decision from the Ukrainian IP Office. That was based on the existence of previously registered, similar trademarks in Ukraine that covered overlapping classes of goods and services.
The IPSTYLE team thoroughly examined the history of use of the cited trademarks, carried out an in-depth analysis, and demonstrated multiple distinctions between the THE / DVIZH TM and the opposing marks. These arguments were included in a well-substantiated response to the refusal.
In addition, we provided evidence of the client’s active use of the mark, confirming its recognition and strong reputation. Our lawyers also successfully argued that the stylized and unique elements of the TM – including the article, the slash, and the dominant word element – form a stable and recognizable brand attribute that clearly differentiates it from others.
As a result, the trademark THE / DVIZH was officially registered on October 22, 2025.
