IPSTYLE's client is a manufacturer of equipment and components for home, garden, and construction products. Their trademark application in the EU was opposed by the trademark holder, who is a seller of high-powered vacuum cleaners and their components.
In order for the opposition to be withdrawn, IPSTYLE's lawyers negotiated and convinced the opponent that the parties' activities did not overlap, that the trademarks had their own distinctive features and could not be confused, that the goods produced for different purposes, and as a result, our client had no intentions to infringe opponent's rights.
Finally, the negotiations were successful, and the opponent withdrew the opposition, which allowed us not to proceed to the next stage of "exchange of the opinions" before the EUIPO, which would have significantly delayed the registration process and required additional resources.
