The client received a lawsuit from its former business partner regarding alleged copyright infringement of the latter when the client developed its own software. In the lawsuit, the opponent requested to establish the fact of copyright infringement and to recognize him as a co-author of the computer program created by the client. As part of the interim relief, the opponent prohibited any sale of the software.
After analyzing the statement of claim, IPSTYLE came to the conclusion that it was groundless. In the course of the analysis, IPSTYLE attorneys developed a strategy for protecting the client's rights, collected evidence confirming the groundlessness of the claim (including an expert opinion, reviews of other experts' opinions and an assessment of non-property intellectual property rights submitted to the court by the opponent), prepared a number of procedural documents to defend the client's position and to recognize the opponent's evidence as improper and inadmissible.
As a result, the court of first instance dismissed the claim in full and canceled the interim measures. The relevant decision remained unchanged after the appeal and cassation reviews of the case.
Based on the results of the trial, IPSTYLE, together with the involved colleagues from another law firm, recovered court costs from the opponent in favor of the client for a total amount of over $11,000.
