IPSTYLE's client, the first licensed winery from the heart of the North of Ukraine, received a provisional refusal with respect to his UA trademark application.
The refusal was based on relative grounds of the prior trademark registration in Ukraine for the same goods. The signs were similar but had obvious visual differences.
Due to the analysis of the client's goods, activities, and market, collection of the provided evidence of use, and, in general, clear arguments on non-similarity of the trademarks, set forth in the response to the provisional refusal, the IPO made a positive decision on registration. Therefore, the client's trademark was granted legal protection for the designated goods of class 33 in Ukraine.
