The Session of UBA ICT Committee On Determination of Сompetent Сourt (Jurisdiction) for Recourse due to Infringement of IP Rights on the Internet took place

On December 1, the Session of UBA ICT Committee (On Telecom, IT & Internet Law ) was organized for discussion of peculiarities of determination of сompetent сourt (jurisdiction) for recourse due to infringement of IP rights on the Internet.

The main subject to discuss was the John Doe concept, international experience of its use, as well as applicability of its implementation in Ukraine. Director of IPStyle Patent Law Company Mariya Ortynska and Head of IP Practice at International Law Firm Eterna Law Ilarion Tomarov examined the concept thoroughly. The meeting was moderated by Mykyta Polatayko, Coordinator of IT Practice at Sayenko Kharenko Law Firm.

"John Doe is an unknown defendant, it can be either a natural person, legal entity or group of persons, - said Mariya Ortynska. - The concept works in the US, Canada, UK, Australia, India. In the United States it is not only John Doe, but also Jane Doe, Baby Doe. In India it is Ashok Kumar and Rakesh Kumar".
